EQUALITY ACT 2010

INTRODUCTION TO THE EQUALITY ACT
From 1 October 2010, the Equality Act replaced most of the Disability Discrimination Act (DDA). The Act aims to end prejudice against less able people. It has been significantly extended over the last ten years and now gives less able people rights in the following areas: Education, employment, renting or buying land or property, access to goods, facilities and services, activities, clubs, sports and associations. Where this restriction is involves the vertical circulation within a building the provision of a lifting platform may provide a solution.

OBLIGATIONS UNDER THE EQUALITY ACT
Obligations under the Equality Act require service providers and workplaces to make reasonable provisions and/or adjustments to overcome physical features, which obstruct the less able to access facilities. To overcome a physical feature means to either remove it, alter it so that it no longer has an effect, provide an alternative access route, or make services available to the less able in another way.

BUILDING DESIGN
It is the building designer’s obligation to ensure that access is provided for the less able to ensure compliance with the Equality Act. Regarding vertical circulation this can be implemented by the use of say ramps, lifts or lifting platforms. It is a general misconception that the Equality Act specifies equipment.

ACCESS STATEMENT
Building designers can then put forward the type of lifting device within the access statement that they feel most suitable depending on the environment and usage among other factors. If personnel lifting devices are incorporated compliant with statutory regulations this will allow the building designer to fulfill his obligations under the Equality Act. The Requirements of Platform Lifts are contained in Part M of the Building Regulations, BS:8300 (called up within the regulation), BS:6440 and EN81-41.

PART M OF THE BUILDING REGULATIONS

AN OVERVIEW OF PART M / SECTION 4.2 OF THE TECHNICAL HANDBOOK (SCOTLAND) – VERTICAL CIRCULATION WITHIN A BUILDING.

Addressing the needs of all people, including those with disabilities, in accessing and moving around buildings. These regulations set out the standards for buildings to be accessible and hazard-free wherever possible.

Part M and Section 4.2 of the Technical Handbook (Scotland) of the Building Regulations was introduced in 1985 in an attempt to ensure that all commercial buildings were suitably equipped for the needs of disabled people. Public buildings at design and building stages must be fitted with adequate access for all potential users of the service.

These requirements were then extended to the building of new homes. Failure to adhere to Part M and Section 4.2 of the Technical Handbook (Scotland) will often result in planning permission not being granted.

EN 81-41: THE NEW EUROPEAN STANDARDS

There is a new European standard EN 81-41 for vertical platform lifts and for which our products again comply. It was drafted by the working group CEN/TC10/WG8 and is for products intended for use by persons with impaired mobility. This standard was as accepted by the CEN Member States by Formal Vote on 06 January 2009.

The new European standard EN 81-41 gives presumption of conformity to both the present and to the new Machinery Directive 2006/42/EC.The new EN standard 81-41 makes it easier for the relevant authorities, architects and planners to understand and for European Notified bodies to assess the safety requirements for vertical platform lifts.

The new standard EN 81-41 improves and raises the safety requirements for European platform lifts, for the benefit of the users.

All Premier Northern Ireland products are in full compliance with the safety requirements of the new European standard EN 81-41.
